When is a Water Law Report required?
A Water Law Report is one of the key documents submitted as part of an application for a water permit. It may be required, among other cases, for water abstraction, wastewater discharge, construction of water facilities, damming or retention of water, as well as other forms of special water use.
Not every investment requires a water permit — in some cases, a water-law notification may be sufficient. Therefore, before commencing the works, it is important to correctly determine the applicable procedure for the planned project.
What does a Water Law Report contain?
The scope of a Water Law Report depends on the type of planned water use or water facility. The documentation includes a descriptive and graphical section, and its content should enable the competent authority to assess the planned project and the conditions of its implementation.
Depending on the scope of the case, the report may include, among other things, a description of the project, the purpose and scope of water use, characteristics of water facilities, technical parameters, water or wastewater balances, operating conditions, an assessment of impacts on the aquatic environment, and map-based and graphical documentation.
How do we prepare a Water Law Report at MASAD?
We begin by analysing the planned project and determining what type of water-law consent is required. We review the available technical, mapping and environmental materials, identify missing data and then prepare the descriptive and graphical sections of the report.
Before submitting the documentation, we verify its completeness and consistency with the planned scope of water use. Where necessary, we also support the client during administrative proceedings and in preparing responses to requests from the competent authority.
What information is needed to prepare a Water Law Report?
The required input data depend on the type of project. They usually include information on the project location, legal title to the property or facilities, technical parameters of the installation, expected quantities of abstracted water or discharged wastewater, operating conditions and the proposed technical solutions.
If the client does not yet have a complete set of materials, we help determine what documents, maps, measurements or technical data need to be obtained before the report can be prepared.

Water Law Report and water permit
A Water Law Report is not the permit itself. It is documentation forming the basis for assessing an application for a water permit. The competent authority reviews the report together with the remaining documents and information collected during the proceedings and then issues its decision.
Polish Waters also states that the permit should be obtained before the investment is commenced, where the planned scope of works requires such a permit.

Water permit or water-law notification?
In some cases, a water-law notification is required instead of a water permit. The correct qualification depends on the type of planned works and the manner in which water will be used.
